Steroids, a serious legal offense

In the context of the recent steroids scandal involving major Major League Baseball players such as Alex Rodriguez, National League MVP Ryan Braun and Francisco Cervelli in connection to the Biogenesis clinic in Miami, our criminal defense team in Fort Lauderdale brings a few key points related to the regulations regarding steroids.

Federal and Florida state laws prohibit the possession, sale or use of anabolic steroids. Anabolic steroids are classified as a schedule III drug under both federal and Florida state law, not considered as dangerous as cocaine or heroin, but more serious than many other drugs.

When you are arrested for anabolic steroids, you may be charged under the Federal Anabolic Steroid Control Acts of 1990 or receive state charges under Florida Statute section 893, usually depending on the amount of steroids in your possession.

No matter the statute under which you receive charges, the punishment can be severe. For example, a first offense of simple possession is punishable under federal law by a term of up to 1 year of incarceration and a fine of at least $1000, while a second offense is punishable under federal law by a minimum of 15 days in jail and as long as two years in prison.

Distribution or possession of anabolic steroids with intent to distribute can result in penalties of up to 5 years in prison under federal law and/or a $250,000 fine. Moreover, sale or distribution of anabolic steroids can result in up to 15 years in state prison if charged under federal law.

Under Florida Statute section 893, if you are charged with possession of steroids and have no valid prescription, you can be subject to a third degree felony, punishable by five years in state prison.
