  • Case Facts: My client was stopped for an equipment violation. After speaking to the officer, he was asked to get out of his vehicle and to perform field sobriety exercises due to a suspicion of DUI. After noticing signs of impairment and witnessing a poor performance on the exercises, the officer arrested my client for DUI. He refused to provide a urine sample.

    Result: After reviewing all of the facts of the case, I filed a motion to suppress the request for urine, arguing that it was unconstitutional and unreasonable given the facts of the case. The judge granted my motion to suppress. The DUI charge was dropped and my client received no conviction and court costs only on the reduced charge of reckless driving.

  • Case Facts: My client was charged with leaving the Scene of an Accident. Video from a parking lot camera shows defendant making contact with another vehicle, getting out if his car, and then leaving the scene.

    Result: After taking a deposition of the officer, I was able to find inconsistencies in their investigation in relation to witness statements and video evidence. After several court hearings and through communication with the prosecutor, I was able to convince the state to completely drop the charges.

  • Case Facts: My client was charged with DUI. He was stopped by officers in his parking garage. Officers noticed a strong odor of alcohol on his breath, bloodshot eyes, slurred speech, and a flushed face. The defendant performed poorly on all roadside exercises and was arrested.

    Result: After thoroughly investigating the case, I decided to file a motion to suppress, arguing that the arrest was improper due in part to the length of the time between the initial stop and the subsequent arrest. I was able to have the charge reduced to reckless driving.

  • Case Facts: My client was stopped for weaving and failure to maintain a single lane. He was subsequently asked to submit to field sobriety tasks upon the officers’ suspicion that he was driving under the influence of alcohol. He was arrested and charged with DUI.

    Result: After reviewing all of the case facts, I filed a motion to suppress the arrest, arguing that the officer lacked probable cause to make an arrest for DUI. After argument, the Judge granted my motion to suppress the arrest. Subsequently, all charges were dropped.

  • Case facts: My client was charged with Felony fleeing and eluding a Law Enforcement Officer. Client was facing a mandatory felony conviction among other penalties.

    Result: After taking deposition of the arresting officer, I was able to establish that it would be difficult to prove that my client had actual intent to flee from law enforcement. I convinced the prosecutor to amend the charge to a traffic criminal charge of reckless driving. The felony was dropped.

  • Case facts: My client was charged with Felony fleeing and eluding a Law Enforcement Officer. Client was facing a mandatory felony conviction among other penalties.

    Result: After taking deposition of the arresting officer, I was able to establish that it would be difficult to prove that my client had actual intent to flee from law enforcement. I convinced the prosecutor to amend the charge to a traffic criminal charge of reckless driving. The felony was dropped.

  • Case Facts: My client was charged with Possession of Cannabis >20 grams, a third-degree felony. The cannabis was found in the defendant’s pants’ pocket and in the vehicle after a traffic stop.

    Result: After taking the deposition of the arresting officer, I filed a motion to suppress, as I determined that this was an illegal stop and illegal search. Before the motion was argued, and the state agreed to drop the felony charge.
